هدفت الد ا رسة إلى التعرف على دور الهيئة العامة لمكافحة الفساد في الحد من ج ا رئم الفساد الإداري في دولة الكويت من وجهة نظر الحقوقيين في محافظة العاصمة في دولة الكويت، والتعرف على الأساليب والإج ا رءات الخاصة بتعزيز دورها في الوقاية من الفساد، وهدفت كذلك إلى الكشف عن الفروق في اتجاهات أف ا رد عينة الد ا رسة نحو دور "الهيئة العامة لمكافحة الفساد" في الحد من الفساد الإداري، والأساليب والإج ا رءات الخاصة بتعزيز دورها في الوقاية من الفساد في دولة الكويت باختلاف متغي ا رت الد ا رسة (طبيعة العمل، الن وع الاجتماعي، الخب رة العملية، المؤهل العلمي).
ولتحقيق أهداف الد ا رسة وجمع بياناتها، تم استخدام منهج المسح الاجتماعي، والاعتماد على أداة الاستبيان لجمع البيانات، وتكون مجتمع الد ا رسة من القضاة والمحامين من محافظة العاصمة في دولة الكويت، وتم استخدام أسلوب المسح الشامل لاختيار عينة الد ا رسة التي تكونت من ( 335 ) قاض ومحام، وتم تحليل البيانات باستخدام أساليب الإحصاء الوصفي، واختبار تحليل التباين الأحادي، واختبار "ت" للعينات المستقلة.
أظهرت نتائج الد ا رسة أن دور "الهيئة العامة لمكافحة الفساد" في الحد من الفساد الإداري في دولة الكويت، جاءت بدرجة مرتفعة، وأن من أهم أدوارها في الحد من الفساد تتمثل في إسهامها في ضبط ج ا رئم الفساد المتعلقة بإساءة استخدام الصلاحيات الممنوحة للمسئولين والموظفين، وفي الحد من ج ا رئم الرشوة، ومن استغلال البعض للثغ ا رت القانونية لتحقيق مكاسب شخصية. وأظهرت النتائج أن اتجاهات الحقوقيين في محافظة العاصمة في دولة الكويت نحو الإج ا رءات المتخذة من قبل "الهيئة العامة لمكافحة الفساد" في الحد من الفساد جاءت بدرجة متوسط، حيث بلغ المتوسط الحسابي العام ( 3.60 )، وأن من أهم الإج ا رءات المتخذة من قبل الهيئة في الحد من الفساد الإداري في دولة الكويت تتمثل في قيامها بمنح صلاحيات واسعة لموظفيها للتحقيق في قضايا الفساد، وأنها تتبع القوانين والأنظمة والإج ا رءات التنفيذية الخاصة بمتابعة شكاوى الفساد في أجه زة الدولة. وأوصت الد ا رسة من خلال نتائجها بعدد من التوصيات من أهمها: قيام "الهيئة العامة لمكافحة الفساد" بوضع الاست ا رتيجيات المناسبة للحد والوقاية من الفساد في المؤسسات العامة في دولة الكويت، التي تتماشى مع روح العصر، ومتابعة تنفيذها من قبل الجهات الرقابية الداخلية في مؤسسات وو ا ز ا رت دولة الكويت.
Abstract
Role of the Anti Corruption General Authority in Reducing Administrative Corruption Crimes
From Jurists' Perspective in the Capital City in Kuwait

The study aimed to identify the role of the anti corruption general authority in reducing administrative corruption crimes in Kuwait from jurists' perspective in the capital city, to identify the methods and procedures related to enhance this role in protection from corruption, and also aimed to identify the differences in the participants attitudes toward the study subjects based on the variables of the study ( nature of work, gender, practical experience and educational qualification ). To achieve the goals of the study, the social survey approach was utilized depending on a questionnaire as the tool of data collection. The society of the study consisted of all judges and lawyers in the capital city of Kuwait and the comprehensive survey approach was utilized to select the sample of the study which was consisted of (335) judges and lawyers. Data were analyzed using the descriptive statistical methods , ANOVA, and the test for dependent samples.
Results indicated that the role of the anti corruption general authority in reducing administrative corruption came at high level and that among its most important roles in reducing corruption were contribution in controlling corruption crimes related to abusing the granted authority for employees and officials , reducing bribery crimes, and controlling the exploitation of some legal lacunae for achieving personal benefits and interests. Results also indicated that Jurists' attitudes in the capital city in Kuwait toward the actions taken by the anti corruption general authority for reducing corruption came at medium level with a mean of ( 3.60 ) , and that among the most important actions taken by the authority for reducing administrative corruption in Kuwait represented in giving its employees the full authority in investigating corruption issues and following the laws and the regulations and the operational actions related to following up corruption complaints within the state agencies.
In light of these results, the study concluded with a group of recommendations among which that the anti corruption general authority should draw the appropriate strategies in order to protect from and reducing corruption within the public institutions in Kuwait in a pattern that is contemporary in addition to follow up the implementation of these strategies by the internal control agencies within the institutions and ministries of Kuwait.
