تأثر حق الملكية في النزاع المسلح

تتناول هذه الدراسة تأثر حق الملكية في النزاع المسلح وهو موضوع يمس حياة المدنيين ويشغل بالهم، خاصة في المجتمعات التي تعيش حاله مستمرة من عدم الاستقرار الأمني جراء النزاعات المسلحة، وقد اتبعت الدراسة المنهج التاريخي والمقارن والتحليلي
وقد جاءت هذه الدراسة في مبحث تمهيدي وفصلين وخاتمه، اما التمهيد فقد تناول ماهية النزاع المسلح وطبيعة تأثيره على القوانين الوطنية
بينما تناول الفصل الأول صور تأثر حق الملكية في النزاع المسلح، باحثا صور تأثر حق الملكية المباشر او عن طريق التأثير على حقي التصرف والانتفاع بوصفهما حقوق متفرعة عنه، وشمل ذلك البحث في ماهية كل حق من هذه الحقوق ومن ثم صور تأثره بالنزاع المسلح
اما الفصل الثاني فقد تناول النتائج المترتبة على تأثر حق الملكية في النزاع المسلح وذلك عن طريق بيان حكم الوقائع القانونية الواقعة على حق الملكية خلال النزاع المسلح والمتمثلة بالعقد والحيازة، ومن ثم البحث في المسؤولية الناتجة عن تأثر حق الملكية في النزاع المسلح والذي تضمن بيان مسؤولية كل من الدولة والمعتدي والغير.

In this study, we will talk about the property and how it is being affected during the armed conflicts. It's a subject that touches the life of the civilians and totally concern them, especially in those communities that live in a constant state of instability and insecurity as a result of the armed conflicts. In this study, the historical method was followed, in addition to both the comparison and analyzing methods.
This study came up with a preliminary, two chapters and a conclusion. talking about the preliminary, it has clarified the essence of the armed conflicts and it's impact on the national laws while the first chapter has discussed some cases of the armed conflicts, whether it was affected directly or by affecting the conductance and utilization as a branched rights of it.
This included the study of the essence of each one of these rights as well as how the armed conflicts affect it.
The second chapter talks over the consequences of the impact of ownership on the armed conflicts by clarifying the judgment of the legal actions on the ownerships during the armed conflicts which are shown clearly by the contract and possession, then the study in the responsibility resulting from the affected ownerships in the armed conflicts which includes the clarification of responsibility for each of the country, the aggressor and the others.
