الملخص
يعتبر تسبيب الحكم أحد اللبنات التي يقوم عليها الحكم القضائي فمن خلاله يقوم القاضي ببيان الأسباب الواقعية و القانونية التي بنى عليها حكمه , وبذلك يتمكن الخصوم من معرفة الأسس و الأسانيد التي بنى عليها القاضي حكمه, كما تقوم المحكمة الأعلى درجة ببسط رقابتها للتأكد من أن القاضي طبّق القانون تطبيقاً سليماً موافقاً للواقع و القانون .
فالتسبيب هو المرآة التي تعكس مجريات الدعوى من دفوع و طلبات و بذلك يكون القاضي حريصاً على أن تكون أحكامه مسببة تسبيباً سائغاً و مقبولاً كي لا تكون عرضة للطعن فيها من قبل الخصوم الأمر الذي يزيد من الأعباء المتراكمة على القضاء .
ومن هنا بينت الدراسة دور التسبيب فهو بالإضافة إلى كونه أداة للإقتناع لضمان عدم تحيز القاضي فهو وسيلة للإطمئنان لبث الثقة و الطمأنينة في نفوس المتقاضين ويدفع عن الأحكام مظنة الريبة و الشك , كما و يساعد التسبيب في رقابة المحكمة العليا على أحكام القضاة .

Abstract
Judical Reasoning is one of the building blocks on which the courts' judgment is based, through which thejudge presents the factual and legal reasons upon which his judgment was constructed. Consequently, the litigants are able to identify the bases upon which the judge built hisjudgment. Furthrmore, the Supreme Court forms a basis for supervision to ensure that the judge has properly applied the law, in parallel with reality.
Judicial Reasoning is the mirror that reflects the course of the proceedings of the defenses and requests, and therefore the judge is keen to have a reasoned judgment which is also asseptable, so as not to be subject to appeal by the litigants and increase the accumulated burden on the judiciary.
The study established the role of Judicial Reasoning to be not only atool for persuasionin order to insure impartiality of the judge, but olso as means of encouraging the public's confidence in the judiciary and the judicial system.
