فقه الاحتياط عند الإباضية
دراسة فقهية مقارنة

تناولت الدراسة فقه الاحتياط في المذهب الإباضي مقارناً بالمذاهب الفقهية الأربعة: (الحنفي, والمالكي, والشافعي, والحنبلي), وقد استهلت الدراسة ببيان مفهوم الاحتياط من خلال التعريفات التي ساقتها الباحثة, كما أعطت لمحة عن ورود الاحتياط في الفقه الإباضي موضحة الألفاظ التي يعبر بها الإباضية عن الاحتياط.
ثم تتبعه ببيان أصل مشروعية الاحتياط بعرض الأدلة والنصوص التي تفيد مشروعيته, ثم استعرضت اتجاهات العلماء في القول بحجية الاحتياط من خلال أقوال العلماء, معرجة على بيان حكم الاحتياط وقد خلصت الباحثة على أن الاحتياط قد تعتريه الأحكام الخمسة حسب تفاوت مقاصده.
كما تناولت الدراسة أقسام الاحتياط مبينة أن الاحتياط ينقسم إلى عدة أنواع باعتبارات مختلفة, ثم تطرقت إلى الشروط المرعية في الأخذ بفقه الاحتياط عند فقهاء الإباضية ومدى انطباق هذه الشروط لدى فقهاء المذاهب الأربعة, ومن ثم عرجت الدراسة على القواعد الأصولية والفقهية مبينة مدى ارتباطها, وعلاقتها بفقه الاحتياط.
وقد اعتمدت الدراسة على المنهج الإستقرائي والمنهج الوصفي التحليلي .
وأخيراً ختمت الدراسة باستعراض نماذج ومسائل تطبيقية لقاعدة الاحتياط وأثرها في باب العبادات, وقسم الأحوال الشخصية, معقبة عليها بموقف الفقهاء من الاحتياط في هذه الأبواب.

This study theme for important sections of Islamic jurisprudence reserve in the doctrine of ovulation compared with the doctrines of the Islamic four: Have started the study made by the concept of the reserve through the definitions given by the researcher, also gave a glimpse of receipt of the reserve in the literature Ibadite explaining the terms that reflect the Ibadi for reservists.
Then followed a statement on the legality of the reserve out of the presentation of evidence and texts according to its legitimacy, and then reviewed the trends scientists to say with greater authority reserves through scholarly, Marjp the statement of the rule of reserve researcher has concluded that the reserves may provisions of the five defects by varying purposes.
The study also considered sections of the reserve, stating that the reserve is divided into several types, various considerations, then dealt to the conditions established in the introduction of the jurisprudence of the reserve when scholars Ibadi and the applicability of these conditions to the scholars of the four schools, and then put a study on the rules of fundamentalism and jurisprudence set out how it relates to, and their relationship to the jurisprudence of reserve.
Finally, the study concluded the review of models and practical issues for the reserve base and its impact in the door of worship, and the Department of Personal Status, Makbp awareness of the position of scholars of reservists in these doors.
