التطبيقات الفقهية لقاعدة الحاجة تنزل منزلة الضرورة في كتابي الطهارة والصلاة

إن من سماحة الشريعة الإسلامية ومرونة الفقه الإسلامي رفع الحرج والمشقة عن العباد في عبادتهم ومعاملتهم، وقاعدة (الحاجة تنزل منزلة الضرورة في كتابي الطهارة والصلاة) ما هي إلا إحدى القواعد الشرعية التي تبدوا فيها هذا السماحة جلية .
وقد تناولت دراسة هذه القاعدة من جهة معناها باعتبارها لفظاً مركباً ولقباً، وخلصت إلى أن مجال تطبيق هذه القاعدة هو الحاجة العامة التي تتعلق بأغلب الناس، والخاصة التي تختص بفئة معينة تنزل منزلة الضرورة، فتعطى حكمها من حيث إباحة المحظور وإن كانت دونها في المرتبة .
وقد قمت بتطبيق هذه القاعدة في كتاب الطهارة على مسألة: استعمال آنية الذهب والفضة، ولبس الذهب للرجال، الدخول بما فيه ذكر الله للخلاء، الكلام أثناء قضاء الحاجة، البول قائماً، والبول في إناء، الاستنجاء والاستجمار باليمين، دخول الحمامات للنساء، كشف العورة، مس الصبيان للمصاحف، المسح على الجبيرة، قراءة القرآن للحائض، ومرور الحائض بالمسجد.
وكذلك طبقت هذه القاعدة في كتاب الصلاة على مسألة: استئجار من يؤذن ويقيم عند عدم التطوع، السكوت اليسير والكلام المباح اليسير أثناء الأذان، لبس الحرير للرجال، إسبال الثوب تحت الكعبين، صلاة المقاتل وهو يحمل سلاحا مطلياً بالدم، مفارقة المأموم إمامه قبل السلام، تأخير قضاء الصلاة، صلاة المرأة في البرقع والنقاب، الفعل اليسير من غير جنس الصلاة أثناء الصلاة، تعدد صلاة الجمعة في البلد الواحد، وشراء الماء للشرب بعد النداء الثاني، التخصر في الصلاة، الالتفات فيها والتنحنح فيها، العبث بشيء من جسده في الصلاة، صلاة الإمام في المحراب.
كل تلك المسائل سواءً كانت في كتاب الطهارة أو في كتاب الصلاة قمت بتطبيق القاعدة عليها، ووجدت أن العلماء جعلوا لها اعتباراً في ترجيحاتهم في ثنايا تلك المسائل.

The tolerance of the Islamic law and flexibility of Islamic jurisprudence and relieve the hardship of people in worship and treatment (and the database need down status of necessity in my book, purity and prayer)is but one of the legal rules that seem the area is evident.
The study examined this rule on the meanings as a ubiquitous compound and titles, and concluded that the definition of this rule is the need for the public on most of the people, and private specializes in a particular category down status if necessary, giving its ruling in terms of legalization of the outlawed though without the mattress.
I have applied this rule in the book of purity on the issue of a mechanism of gold and silver , and wearing gold for men, and incomes, including the said evacuation of the toilet, and talk while on the need, and urine or urinating in a pot, cleaning oneself after defecating or urinating under oath and toilets for women, and uncover the genitalia touching the boys to copies wiping over the plaster and read the quran by menstruating and menstruating women over the mosque. All of these issues, whether in book or in the purity prayer book I apply the rule and found that scientists have made a consideration in his heart at the of those issues.
